Acquittal instead of €3,600 fine!

In November 2023, one of our clients was accused of making false statements in a naturalisation application. The Düsseldorf Local Court then issued a penalty order. Our client was suddenly confronted with serious legal consequences, even though he was convinced of his innocence.

Our procedure: Thorough examination of the case files

After receiving the case files, we carried out a comprehensive review of the documents. In doing so, we discovered a crucial inconsistency:

The application for citizenship on which the indictment was based had never been signed by our client. This fact called the entire indictment into question, as there was no legally binding declaration without a signature.

The result: cancellation of the penalty order and an acquittal

Thanks to our meticulous work and determination to shed light on every aspect of the case, we were able to prove that the charge was based on a formal error. The court recognised this and the penalty order was eventually quashed. Our client did not have to pay a fine and was ultimately acquitted.
