Enterprise (Alamo) keeps the deposit!
Is the claim for damages justified?

For which damages is the renter of a rental car liable?

Many renters experience it after returning their rental vehicle: Enterprise (Alamo) demands compensation and collects the deposit.

Doch ist die Forderung überhaupt berechtigt?

Readers of our article on Sixt and car hire rip-offs will recognise some of these methods. There, we explained the damage for which car hire companies are liable and when liability does not apply in principle - for example, in the case of existing, unrepaired previous damage.

In this article, we examine the common practice of Enterprise Holdings Inc. (in Germany: Enterprise Autovermietung Deutschland B.V. & Co. KG), which also operates under the Alamo brand, in connection with claims.

I. E-mail from the rental company after returning the vehicle

Nach der Rückgabe des Mietwagens erhalten viele Kunden eine After returning the rental car, many customers receive an email from Enterprise (Alamo)..

This often comes from an ‘Assistant Brand Rental Manager’.

1. Questions about the rental vehicle

In the e-mail, the renter is informed that damage or scratches have been detected. The customer is given the opportunity to comment on this.

2. notification of the retention of the deposit

The e-mail also states that the deposit will be temporarily withheld until the matter has been clarified.

➡ Tip: Renters should respond carefully to this email and document the condition of the vehicle well upon return.

II. Billing of the rental car company

Many of those affected receive a bill from Enterprise (Alamo) shortly afterwards, which is made up of several documents.

1. Repair cost calculation of the TÜV

An important component of this settlement is a repair cost calculation from the Technical Inspection Association (TÜV).

🛑 Attention: A repair cost calculation is not an expert report!

  • Previous damage is usually not taken into account;
  • The calculation is often made without inspecting the vehicle - using only the photos submitted (‘tele-calculation’).

2. Announcement of the credit card charge

The bill often contains a message that the credit card on file will be charged automatically if the claim for damages is not paid on time.

III. Communication with the damage department

Many hirers try to defend themselves against the claim. But Enterprise's claims department often responds with text modules:

  • It is claimed that all previous damage is documented;
  • Customers often do not receive detailed evidence, but only general response modules;
  • If no agreement is reached, Enterprise declines further communication and declares the case ‘closed’.
